Private Calendar To the calendar

Terms and conditions

Last updated: 29 October 2026

These terms govern the use of Private Calendar and also fulfil the information requirements under Article 14 of Regulation (EU) 2022/2065 on digital services (DSA). They explain which content is prohibited, the measures the provider uses to address it and how affected persons can challenge those measures.

1. Provider and scope

The provider is Julius Kramer; address and contact details are in the legal notice. These terms apply to the web application at my.privatecalendar.de and the Android and iPhone apps.

The service is provided on a free basic plan (“Free”). A paid Premium subscription is also available (see section 3).

2. Subject of the Service

Private Calendar provides end-to-end encrypted calendar synchronization between your devices. Calendar content is encrypted on the device; the server stores and transmits ciphertext and technically necessary metadata. For external iCal calendars that you explicitly subscribe to, the Android and iPhone apps retrieve the private address directly from the selected source, process the ICS file locally and synchronize only the encrypted subscription link and imported entries. Details are set out in the Privacy Policy.

3. Paid Premium Subscription

Premium adds features beyond the free plan: more calendars of your own, sharing your calendars, external iCal subscriptions, publishing booking and availability links, and more storage. Sending a request through another person’s booking link requires neither Premium nor an account. Publishing or changing your own booking links and processing incoming requests requires Premium. When Premium ends, existing booking links and requests are not deleted. The booking page remains accessible and accepts requests, but you can open and answer them again only once Premium is active. Deactivate or delete booking links before your subscription ends if you do not want this. Current features and prices are on the “Pricing” page.

With Premium, you can use multiple Home Screen widgets in the Android or iPhone app. For each widget, choose day, three days side by side, month or agenda, the calendars to display, and a light or dark appearance. Day and three-day views show an hourly grid with a line marking the current time. The month view shows up to three appointment blocks per day, followed by “..” for additional entries. Tap a day to open it in the app’s day view. The month view requires a large widget. On iPhone, the agenda shows a limited selection; open the app for more appointments.

The time line advances when the widget updates. The operating system determines when updates occur; the display is not a second-accurate live clock.

For each widget, choose between busy times and appointment titles. Busy times appear as grey blocks without titles, matching the availability display. Visible content can be read outside the biometric app lock and is managed by the operating system or launcher. Busy times without titles are shown by default.

Widgets show the latest locally available data. Changes on other devices appear after the next successful sync. The operating system may delay or prevent updates; being offline, power saving and force-stopping limit freshness. The display shows the last successful sync. Widgets do not replace reliable deadline monitoring.

Android and iPhone widgets are part of Premium. When Premium access ends, their next update permitted by the operating system replaces appointment content with a notice. Calendar data and normal encrypted sync remain available.

Prices and VAT

For a billing address in Germany, the provider sells the service directly as a small business within the meaning of section 19 of the German VAT Act (UStG); VAT is not separately shown. For billing addresses in Austria, Switzerland, Finland, Denmark, the Netherlands, Ireland or Sweden, the provider remains your contractual partner, while Link (Stripe Managed Payments) handles payment, invoices and taxes on the provider’s behalf. Applicable taxes are added to the base price for new orders. The pricing page shows the base price, tax surcharge and total for each billing period according to the selected billing country. The final tax calculation is based on your billing details and is shown in Link Checkout before you complete payment. Existing subscriptions retain their agreed price object and are not converted to prices plus tax by this change. This offer is intended for consumers. Existing subscriptions are not automatically transferred to another payment route.

Plan prices are shown in EUR. Depending on availability, Link may offer payment in a local currency, such as CHF, DKK or SEK. No particular currency or payment method is guaranteed; the actual checkout offer applies. The exchange rate displayed before payment may include a conversion fee; check the offered currency and total before completing payment. When refunding in the chosen payment currency, Link uses the exchange rate of the original payment.

Conclusion of contract and payment

Clicking “Subscribe with obligation to pay” and completing payment submits a binding offer for Premium. The contract is concluded only when we accept your offer. We accept through the order confirmation emailed immediately after our checks; it also confirms receipt of your order. Before acceptance, we check Stripe’s reported billing country and payment route (see “Billing country and payment route”). Payment is processed through Stripe Payments Europe, Ltd. Direct German purchases support only credit card payments, with no SEPA direct debit. For billing addresses in Austria, Switzerland, Finland, Denmark, the Netherlands, Ireland or Sweden, the Premium contract is also between you and the provider. Sold through Link, LLC (USA) acts as merchant of record on the provider’s behalf: it collects payment, shows available payment methods in Checkout, issues invoices, remits applicable indirect taxes and provides payment support. Checkout displays “Sold through Link”. The Link terms displayed there also apply to payment processing. Service performance, contract terms, cancellation and withdrawal remain governed by these terms; address declarations to the provider. Stripe alone processes card details; the provider receives no complete payment details. Immediately after the contract is concluded, you receive all contract details and withdrawal instructions by email on a durable medium. Stripe provides invoices.

Order steps and correction options

  1. On the “Pricing” page, you choose a monthly or annual subscription. The service, total price, term, renewal, cancellation, payment method and right of withdrawal are displayed there immediately before the order is placed.
  2. If you do not yet have an account, or it is not recognised on this device, first create a free account or sign in. This does not order a Premium subscription.
  3. Before clicking “Subscribe with obligation to pay”, you can change your plan selection and correct input errors using the usual browser functions. Clicking opens the Stripe-hosted payment process for your selected plan.
  4. With Stripe, you can check and correct your name, billing address and card details before completing the payment, or cancel the process and return to the plan selection. By completing the payment process, you submit your binding offer; the contract comes into effect with our order confirmation.

Billing country and payment route

You choose the country of your actual billing address before checkout. Germany is billed directly via Stripe; Austria, Switzerland, Finland, Denmark, the Netherlands, Ireland and Sweden via Link (Stripe Managed Payments). Other billing addresses are blocked for new Premium subscriptions.

If the check after payment shows that the billing country does not match the payment route or is not supported, we do not accept the order. Any amount that has already been collected will immediately be fully refunded via the payment method used. Premium will not be activated and we will inform you by email. Your free account and calendar data remain unaffected. A later change of address alone does not convert an existing subscription to another payment method.

Contract language and storage of the contract text

The contract languages are German and English. Contract documents and the order confirmation are issued in the language selected for account emails. The provider stores order and payment data and the version of the terms applicable when the contract is concluded. Immediately after conclusion, you receive the order confirmation and complete contract documents as an immutable text file by email. This version also remains permanently accessible through the link in the confirmation. Before ordering, you can save the terms using your browser’s print or save function.

Term, automatic renewal and cancellation

The subscription initially runs for your selected fixed term of one or twelve months and can be cancelled at its end. It then continues indefinitely, cancellable at any time with one month’s notice. Renewal creates no new fixed-term commitment.

An annual subscription is still payable annually in advance. If cancellation ends the contract within a paid period, the provider refunds the amount attributable to the time after the contract ends on a daily pro rata basis, from the contract end date to the end of the paid period. Already-started months are not retained.

Cancel without signing in on the Cancel contract page or through the route provided in the web app under “Subscription & Payment”. All Premium features remain available until cancellation takes effect. The right to terminate for cause remains unaffected.

For new annual subscriptions with Denmark as the billing country, the following applies during the first year: you may cancel after five months from conclusion of the contract with one month’s notice to the end of a calendar month. You may give notice in advance; the notice period then runs from the end of the five months. We promptly refund prepaid fees for the time after effective termination in proportion to the unused time. Automatic continuation does not create a new annual fixed term. After the first year, the more favourable notice period of at most one month applies, without waiting for month-end. Existing contracts retain their agreed terms; mandatory rights remain unaffected.

For Finland, applicable rights to end the contract early following a significant unexpected change in life circumstances remain unaffected, for example illness, unemployment or disability resulting in financial difficulty. Where applicable law provides this right, only fees up to effective termination are owed. You may submit such notice through the cancellation route as an extraordinary cancellation or send a freely worded declaration to the provider. After the initial term, subscriptions in Finland, the Netherlands, Ireland and Sweden also continue indefinitely and may be cancelled with at most one month’s notice.

Right of withdrawal

As a consumer, you have a fourteen-day right of withdrawal. We refund the full amount paid, without deductions or compensation for time already used. This also applies to billing addresses in Austria, Switzerland, Finland, Denmark, the Netherlands, Ireland and Sweden: address withdrawal to the provider, and Link refunds your original payment method. Details, direct online withdrawal and the model form are in the withdrawal instructions; automatic online withdrawal with an immediate refund is at automatic withdrawal page. The “Withdraw from contract” button in every page’s footer remains available.

Prices and price changes

For an existing contract, the price agreed upon when the contract was concluded applies. Price changes during an ongoing contract require your express consent; silence, continued use or failure to terminate does not constitute consent. Without consent, the contract will continue at its previous price unless it is terminated according to the agreed or legal rules. There will be no price change during the initial fixed term that has already been paid. The provider can only offer changed prices for new contracts concluded in the future without your consent.

Downgrade without data loss

If the Premium subscription ends (due to cancellation or non-payment), the free plan applies again after a grace period of 14 days. No data will be deleted. Content that goes beyond the free limits (e.g. additional calendars or your own shares) becomes read-only until a Premium subscription is reinstated or usage has been reduced below the free limits.

Refunds

If you cancel during the renewal period, the provider refunds the amount attributable to the period after the contract ends on a daily pro rata basis (see “Term, automatic renewal and cancellation”). The decisive date is the date the contract ends: the corresponding share is refunded for each subsequent day within the paid period. If the contract ends at the end of a paid period, no refund is due. Statutory rights, particularly withdrawal and warranty rights, remain unaffected.

Invite friends: additional Premium time

You can use your personal referral code to invite new people to Private Calendar. The code is entered into a verified account upon registration or within the first seven days of registration, always before the first Premium purchase. Each referred account can be assigned to exactly one referral. Self-referrals and referrals between accounts of the same person are excluded.

For the first successfully paid annual subscription, both accounts receive six calendar months of Premium free. For the first successfully paid monthly subscription, both accounts receive two calendar months of Premium free. Eligibility is checked fourteen days after contract conclusion or first payment, whichever is later. The payment must remain valid: refunded or disputed payments, free orders, rejected orders and withdrawn contracts do not qualify. Renewals, plan changes and additional subscriptions for the same referred person trigger no further reward.

A maximum of twelve annual rewards and three monthly rewards can be redeemed per account. The limits are independent of each other and apply to both accounts involved, including a reward that you receive as a referred person. After the first payment, available redemptions will be reserved for both accounts. If the check is negative, the reservation is released; if a limit has already been exhausted, there will be no further Premium for this plan. Before purchasing, your account will display available redemptions.

The free months are automatically added to your existing Premium time. For an ongoing, renewing subscription, the next debit will be postponed accordingly; the agreed plan then applies again. The originally paid term, your right to cancel and the calculation of a refund remain intact: free time is neither treated as paid time nor does it extend a minimum contract term. Terminations that have already been declared will not be cancelled by the bonus. Without a current subscription, you receive the time without having to pay and without automatically taking out a new subscription. Larger bonus credits remain saved and are added gradually if the technical time limits of the payment service require this.

Rewards cannot be paid out in cash or transferred. Both accounts must still exist and be verified when the reward is checked. Deleting an account removes its codes and unused rewards; rewards already credited to the other person remain. The referral overview does not disclose the names or email addresses of referred persons.

4. Account, access and personal responsibility

Key loss is permanent. End-to-end encryption means the provider has no access to your keys. If you lose your password and have no recovery key, your stored calendar data cannot be recovered by anyone, including by the provider. Keep the recovery key generated during setup safe and separate, and use exports for your own backups.

5. Acceptable Use and Content Restrictions

The Service may not be used to store, distribute or transmit content that violates applicable law. In particular, the following is prohibited:

6. Content Moderation: Means and Procedures

The means and procedures used in accordance with Article 14 Para. 1 DSA are as follows.

Technical limits of inspection

Calendar content, including encrypted copies of external iCal subscriptions, is end-to-end encrypted. The provider holds no keys and cannot access titles, locations, descriptions or participants in these encrypted calendar blocks. Stored encrypted calendar content is therefore not inspected, and such inspection is technically impossible. There are no random searches, automated content comparisons or scans of calendar content.

No automated decision making

Decisions about actions against accounts are made exclusively by a natural person. There is no use of algorithmic decision-making for content moderation. Only technical protective measures without any content reference are carried out automatically, namely rate limits, size limits of requests and a temporary block after several failed login attempts.

Possible measures

If a violation is determined on the basis of a report or an official order, the following can be considered:

Measures are taken carefully, objectively and proportionately and taking into account the fundamental rights of all those involved, in particular freedom of expression and the protection of personal data (Article 14 (4) DSA).

7. Reporting illegal content

Reports under Article 16 DSA can be sent to the central contact point at any time. The required information is described in the legal notice. Receipt is confirmed promptly. The reporting person is informed of the decision, reasons and available remedies.

If an account is affected by a measure, the person concerned will receive a clear and specific justification in accordance with Art. 17 DSA. This states the measure and its scope, the underlying facts, the legal basis or the violated provision of these conditions as well as the options for taking action against the decision.

8. Complaints against decisions

A complaint can be made informally against a blocking, termination or other measure at the contact point mentioned in the legal notice. The complaint is examined by a natural person; if it proves to be justified, the measure will be lifted immediately. Recourse to the courts and the possibility of contacting a competent authority remain unaffected.

9. Availability

The service is provided with the care expected of a prudent operator. No specific availability is guaranteed. Maintenance, disruptions affecting upstream providers and circumstances beyond the provider’s control may cause temporary interruptions. The provider regularly creates encrypted backups; these do not replace your own backups.

10. Termination

You can schedule account deletion in settings at any time. If you cannot sign in, use Delete account. After confirmation — confirmation phrase, password and email code in the app, or email address and email code on the public page — deletion is scheduled after a 48-hour waiting period. The account and data remain intact during this period, and a signed-in session can cancel it using the account password. Afterwards, the account, sessions, key containers, shares and active calendar data are irreversibly deleted. Offsite encrypted blocks and backups are removed within thirty days. Any existing Premium subscription is automatically cancelled at permanent account deletion. Statutory invoice records, evidence of confirmed cancellations retained for a limited period, and a temporary technical deletion-control record are retained only for the purposes and periods in the privacy policy.

The provider can terminate a free contract with one month's notice. The provider can terminate a paid Premium subscription with one month's notice only at the end of the billing period that has already been paid for; ordinary termination during the initial paid fixed term is excluded. The legal rights of both parties to extraordinary termination for good cause remain unaffected. Before an extraordinary termination due to a remediable violation, an unsuccessful warning is generally given or an appropriate deadline for remedial action is set, unless this is not legally required.

11. Liability

The provider is liable without limitation in the event of intent and gross negligence, in the event of injury to life, body or health, in the event of the assumption of a guarantee and in accordance with the Product Liability Act.

In the event of a slightly negligent violation of an essential contractual obligation – i.e. an obligation whose fulfillment is essential for proper implementation and whose compliance can regularly be relied upon – liability is limited to the foreseeable damage typical for the contract. Otherwise liability is excluded.

The recommendation to make regular exports and the notice about the technical finality of a self-caused loss of keys in section 4 do not limit the provider’s statutory liability. Mandatory statutory remedies for lack of conformity, damages and reimbursement of expenses remain fully available and take precedence over the provisions above.

Mandatory consumer rights under the law applicable to you always take precedence over limitations and exclusions of liability. In particular, these terms do not exclude or restrict mandatory remedies for failure to supply or lack of conformity of the digital service, including remedies to bring it into conformity, price reduction, termination, reimbursement or damages.

12. Changes to these Terms

Changes to the contractual conditions for an existing contract generally require your express consent. Mere continued use, your silence or failure to terminate do not constitute consent. Editorial corrections that do not change rights and obligations can be made without consent.

Changes to the digital service

Beyond the updates needed to keep it in conformity with the contract, the provider may only change the digital service at no additional cost and for one of the following valid reasons:

Any changes will be communicated clearly and comprehensibly. If a change significantly affects your access or usability, you will receive an email on a durable medium with the characteristics and time of the change as well as your rights in good time before it takes effect. You can then terminate the contract free of charge within 30 days of receipt of the information or of the later date of change. The right to terminate only lapses if the impairment is insignificant or if you retain the unchanged version in accordance with the contract without additional costs. Further legal rights remain unaffected.

13. Statutory defect rights and updates

The statutory defect rights apply without restriction to the digital service, in particular §§ 327d ff. BGB. In the event of a defect, you can, in accordance with the legal requirements, demand subsequent performance, terminate the contract or reduce the price and demand compensation for damages or expenses. Statutory limitation rules and burden of proof rules are not restricted by these conditions.

During the legally required provision period, the provider supplies and informs you about the updates needed to maintain conformity with the contract, including security updates. If, despite receiving the required information, you do not install a properly supplied update within a reasonable period, the legal consequences under section 327f of the German Civil Code (BGB) apply.

14. Technical requirements and compatibility

The web application requires an account, an accessible email address, an HTTPS Internet connection and a current browser with JavaScript enabled and support for Web Crypto and IndexedDB. After successful sign-in and unlocking, calendar data already loaded can be used offline temporarily; browser synchronization and browser reminders work only while the application is open. Android and iPhone apps are available on Google Play and the App Store. The Android app requires Android 8.0 or later; the iPhone app requires iOS 17 or later. On all platforms, reminders and background work may be delayed or prevented by the operating system, browser, permissions, power saving rules, device memory or network. They must not be the sole means of monitoring critical deadlines. External iCal subscriptions are updated only by the signed-in Android or iPhone app. Automatic retrieval is attempted no sooner than approximately every six hours, provided the platform permits background work and the network and external source are available. No specific retrieval time or successful update is guaranteed. The browser app can create subscriptions and display synchronized copies, but cannot update the source itself. Current mainstream versions of Chrome, Edge, Firefox and Safari are supported; unusual or outdated environments may have limited interoperability.

15. Applicable Law

German law applies. For consumers, this applies only insofar as it does not deprive them of the protection of mandatory provisions of the law of the country in which they have their habitual residence.
